POSTHOC Privacy Policy

Your privacy is important to Charles River Analytics, Inc. (“Developer”, “we,” or “us”).  This Privacy Policy describes the information practices of Developer in connection with the Beta App, including what type of information is gathered and tracked, how the information is used, and with whom the information is shared. As described below, this Privacy Policy applies to your use of the Beta App.

BY USING THE BETA APP, YOU INDICATE YOUR UNDERSTANDING AND ACCEPTANCE OF THESE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE BETA APP.

Please carefully read this Privacy Policy as it may have changed since your last visit to the Beta App. Continued use of the Beta App indicates your understanding and acceptance of any changes made to this Privacy Policy and posted to the Beta App. This Privacy Policy does not cover the privacy practices of any third-party websites to which the Beta App may link.

Definitions

  • Beta App” means the POSTHOC mobile application provided by Developer for managing cancer survivor health through digital survivorship care plans, including all content, tools, interactions, and features available in the application.
  • Customer” means the University of Maryland, Baltimore.
  • End User” means an individual who has installed or used the Beta App on any device.

 

Applicability

This Privacy Policy applies to information collected from End Users by Developer through the Beta App. This Privacy Policy does not apply to information that we collect offline or on any other Developer apps or websites, or to information that you provide to any third party. This Privacy Policy only covers Developer’s practices with respect to your information and does not cover the practices of Customer with respect to information you provide to Customer. 

Information We Collect

We collect information directly from you when you provide it to us and automatically when you use the Beta App as described below.

Information You Provide to Us:  When you download and use the Beta App, you will be required to provide the login credentials assigned to you by Customer, which may include usernames, passwords, and other unique identifiers (collectively “Access Credentials”). In addition, when you use the Beta App, we may ask you to provide information that is about you but individually does not identify you, such as performance data generated by your use of the Beta App, information that you provide by filling in forms in the Beta App, or your responses to surveys that we might ask you to complete for research purposes (collectively “End User Date”). End User Data includes responses to surveys on End Users’ current health symptoms, nutrition, and physical activity. Note that End User Data is anonymized and does not contain Personal Information.

Information We Receive From Third Parties: If you choose to connect your account on the Beta App to your account on another service, we may receive information from the other service. For example, if you connect to Fitbit, we may receive information like your minutes of physical activity, number of steps, and sleep duration. You can stop sharing the information from the other service with us by removing our access to that other service. However, if you select this setting, you may be unable to access certain parts of the Beta App.

Automatic Information Collection: When you download, access, and use the Beta App, it may use technology to automatically collect certain details about your access to and use of the Beta App, including traffic data, logs, and other communication data and the resources that you access and use on or through the Beta App, as well as information about your mobile device and internet connection, including the device’s unique device identifier, operating system, and mobile network information.

No Personal Information Collected: Person information is information that could be used to identify an individual such as your name, email address, phone number, and physical address. DEVELOPER DOES NOT COLLECT PERSONAL INFORMATION FROM END USERS THROUGH THE APP. Developer also does not communicate directly with End Users and there is no need for End Users to provide any personal information to Developer by any means. Any communications with respect to the End User’s use of the App must be resolved between the End User and Customer – you should not contact Developer directly to report or resolve any issues with the Beta App. While Developer will never intentionally collect personal information from an End User, in the event an End User provides personal information to Developer, it is Developer’s practice to promptly delete such personal information upon becoming aware of it.

How We Use Your Information

We use the information that we collect from you to:

  • Provide you with the Beta App and its contents.
  • Monitor performance of the Beta App and resolve bugs.
  • Fulfill any other purpose for which you provide your information to us.
  • Carry out our obligations and enforce our rights arising from any contracts between Developer and Customer.

 

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to estimate our audience size and usage patterns, and store information about your preferences and activities in the Beta App, allowing us to customize the content displayed to you.

Sharing of Your Information

The Customer and the Developer may share the information collected from you, and may disclose aggregated information about End Users, and information that does not identify any End User, without restriction. In addition, we may disclose the information we collect:

  • To our affiliates, meaning any entity that, directly or indirectly, through one or more intermediaries, controls, is controlled by, or is under common control with Developer;
  • To contractors, service providers, and other third parties we use to support our business;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Developer’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by Developer about End Users is among the assets transferred;
  • For any other purpose disclosed by us when you provide the information;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce our rights arising from any contracts entered into between you and us, including the End User License Agreement; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Developers, our customers, or others.

 

Safeguarding Your Information

In order to protect your information from improper disclosure, Developer uses commercially reasonable efforts to maintain a secure operating environment to protect any information we collect. The information collected through the Beta App is transmitted in an encrypted manner and stored on secure servers located in the U.S. While we are committed to protecting your privacy, please be aware that no transaction over the internet can be completely secure.

Notice to Minors and their Parents or Legal Guardians

The Beta App is intended for adults. We do not knowingly or intentionally collect information from anyone under the age of 18 through the Beta App. IF YOU ARE UNDER THE AGE OF 18, PLEASE DO NOT USE THE BETA APP OR PROVIDE ANY PERSONAL INFORMATION TO DEVELOPER THROUGH ANY MEANS. In the event Developer receives information from a minor, it is Developer’s practice to immediately delete such information upon discovery that such information is in Developer’s possession. If you know of a minor who has provided us with information, please contact us immediately.

Changes to this Privacy Policy

Developer reserves the right to change this Privacy Policy from time to time. If we do make changes, the revised Privacy Policy will be posted on the Beta App. Your continued use of the Beta App following the posting of any changes indicates your acceptance of the Privacy Policy as changed.
